Millionaire Heiress Can’t Inherit Trust Because She Refuses to Work

Clare Brown, who’s 26 years old and lives in Australia, is heiress to a $12 million fortune. The money was put in a Trust by her father, for her use after he passed away. However, he had stipulations on the Trust that Brown needed to be a productive member of society and have a job. She has refused to do this and is challenging the stipulations to gain access to the funds kept in the Trust.

She cites her attention deficit disorder as making it difficult for her to work and claims that she should have access to the money without being required to get a job. Currently, Brown lives on welfare and calls herself a “broke millionaire.” Naturally, her family is frustrated with this development and continues to encourage her to get a job. It’s not clear whether Brown must work full-time to receive the money, or whether a part-time job would be enough to satisfy the conditions of the Will.

She lives with her wife and daughter in a Western suburb of Sydney, and states that she is frequently broke and has to go without things she wants and needs. Having grown up in a wealthy family this is a very different experience for her. Family members insist that they have done nothing but love and care for Brown and that she simply doesn’t want to work. Brown maintains that she is completely incapable of getting a job of any kind due to her diagnosis.

Now that she has sued the Trust it remains to be seen whether the court will side with her and find the stipulations unenforceable, or whether she will have to contribute to society and get a job if she wants to access the Trust. It’s also not clear what will happen to the money if Brown never uses it since her mother and father have both passed away. Brown’s father made her his sole heir, so it’s going to be up to the court to decide what happens next unless Brown has a change of heart.
